Court clears way for Justice to investigate Starr

Third-party challenge dismissed

WASHINGTON (AllPolitics, March 18) -- The Justice Department can go forward with its investigation of Independent Counsel Ken Starr after a federal appeals court Thursday dismissed an outside challenge to the probe.

The three-judge panel rejected a claim by the Landmark Legal Foundation, a conservative group, which had gone to the court to block Attorney General Janet Reno from investigating Starr and his office. The panel held Landmark had no legal standing to intervene.

And because of its own limited jurisdiction, the court said it did not have the power to review the attorney general's action and could not go beyond the powers set out in the Ethics In Government Act.

"That act enumerates our limited powers. The enumeration does not include the relief prayed (sought) by Landmark ..." the court said.

Landmark is a private conservative group. It argued that only Congress -- not Reno -- could investigate the independent counsel.

Both the Justice Department and Starr's office opposed Landmark's request, arguing that the group had no legal standing to intercede in the case.

The panel agreed, saying Landmark could not sustain its case because the organization has not "suffered a concrete and actual or imminent injury" by the Justice Department's investigation.

"We find nothing in Landmark's motion that could even remotely be considered an injury to itself," the court said.

The Justice Department is investigating allegations of misconduct by Starr and his prosecutors during their investigation of President Bill Clinton's relationship with Monica Lewinsky.

Justice: Judges can't intervene

In a brief to the court, the Justice Department outlined its position that the three-judge panel had no jurisdiction to rule on whether the attorney general has authority to investigate Starr's office.

The judges, in turn, ordered the Justice Department and Starr's office to respond to the Landmark 's attempt to block Reno. The court's order requiring Starr and Reno to outline their positions, clearly suggested the judges believed they may have some jurisdiction.

But Justice's motion stated the independent counsel statute provides the three-judge panel no power to intervene in such matters and concluded the law clearly provided Reno authority to investigate Starr.

The independent counsel statute allows the attorney general to fire an independent counsel for "good cause." As a result, the attorney general must have some method or means to reach her decision, Justice officials concluded.

In a separate filing, Starr's office agreed that Landmark had no standing to intervene.

However, Starr chose not address whether the three-judge panel had jurisdiction in the case.

Among the possible irregularities that Justice is looking into include Starr's request to Attorney General Janet Reno for jurisdiction to investigate the Lewinsky matter and the initial meetings between the counsel's office and Lewinsky in January 1998.

WASHINGTON (AP) -- A federal judge on Thursday dismissed a criminal count against presidential friend Webster Hubbell in a fraud indictment that makes references to Hillary Rodham Clinton.

The count accused Hubbell of scheming to conceal work done by him and Mrs. Clinton, his former law partner, on a failed Arkansas land deal.

U.S. District Judge James Robertson agreed with Hubbell that the allegations in the count were too vague.

"The charging language ... alleges no specific act or acts of concealment by 'trick, scheme or device' and no specific 'false, fictitious, or fraudulent statements or representations," the judge said, citing specific language of federal law. "It is non-specific."

Independent Counsel Kenneth Starr had obtained a 15-count indictment of Hubbell last November in connection with a land deal known as Castle Grande. Federal regulators said the deal was riddled with "insider dealing, fictitious sales and land flips."

Mrs. Clinton was referred to 36 times in the original indictment against Hubbell, signifying that her name could be brought up repeatedly in the trial set to begin June 14. She could be called to testify.

The Clintons' Whitewater partner, the late James McDougal, tried to sell off pieces of Castle Grande to prop up his collapsing savings and loan.

The dismissed count charged that from March 1989 through December 1995, Hubbell tried to cover up the true nature of his and Mrs. Clinton's relationships with Hubbell's father-in-law, Seth Ward; with McDougal's Madison Guaranty bank and the land deal.

Hubbell also was accused of making "false and fraudulent" statements and representations to two U.S. banking regulatory agencies.

"Hubbell argues that Count 1 is a 'catch all' count that fails to inform him clearly of the precise offense of which he is accused so that he may prepare his defense," Robertson wrote in 18-page opinion.

"He points out reasonably that a jury might convict if it unanimously accepted the generality of the charge of 'scheming,' although split on which (if any) of the many acts alleged ... (that) Hubbell actually committed."

Starr's office maintained that the count was "sufficiently specific" and that it was not necessary for that count "to set forth precisely the false statements and acts of concealment upon which it depends ...," the opinion said. The independent counsel contended the concealment scheme was the offense, rather than any specific act.

I see that the Justice Department is once again in favor here now that the target is Ken Starr and not Bill Clinton. Interesting how the times change. Now that the target of the investigation is a "Right Winger" the Law is important again. Anyone care to place a bet on the number of convictions this new investigation will produce? Here is the trick. Just say something nasty about Ken Starr or something nice about Susan McDougal, or Hillary then you will not get deleted.
Just look at what this "Susan" character gets away with. She says all sorts of hateful and extremist things and is actually praised.

It's sad we have to deal with such hypocrisy, but the editor does have the power.

This page is the Hillary (and Susan) defense forum. The fact that the Editors (note the plural!) allow ANY non-Hillary-(and-Susan)-Defense messages is, in itself, generous.

If you really want to get to them just ask them to defend Bill and Hillary's positions on policy. I must have posted a dozen messages about the Social Security Investment Scam (where the Feds gamble on stocks with a quarter of YOUR Social Security fund, even Greenspan said it was nuts) but I never got a single reply. The fact that Bill is a slimy rapist and Hillary is the enabler and brains behind the operation is well established. Hell, they are openly admired for being so slick! But the fact that their policies will destroy this nation is seldom pointed out here. (Believe it or not, Bill and Hillary are NOT responsible for the legalization of Infanticide so drop that one already.) The Healthcare Scam (that the Democratic Congress wouldn't even entertain) was a big factor in the '94 elections. Message: Ira Magaziner and Hillary Clinton lied to the American people and the court according to a ruling by federal judge Royce Lamberth. They lied about numerous items concerning Hillary�s secret task force which she set up at the expense of the taxpayers, to force socialized medicine on this country. This plan would have handed over our health care system to government beauracrats, and despite what you�ve been told by the Clinton�s, you would not be able to pick your own doctor. And Hillary operated in secrecy. Lying to this day about which special interests were buying into the plan, while keeping Americans in the dark. Judge Lamberth called the actions of Hillary and Ira Magaziner so dishonest and so reprehensible that he ordered the White House to pay the legal bills amounting to 285,000 dollars. But Bill Clinton declared that the taxpayers would foot the bill, and that the deceptive Ira Magaziner would stay on board. The bottom line here is that despite the courts ruling, Ira Magaziner and Hillary Clinton will face no penalty of any kind for lying to the court and the American people. But this is the Clinton�s were discussing, did you expect anything less?

President Bill Clinton lied repeatedly during his Friday press conference, avoiding the truth when discussing the China spying scandal, his relationship with his wife and charges that he raped Juanita Broaddrick, an analysis by two experts shows.

Capitol Hill Blue hired a psychologist who treats chronic liars and a private investigator who uses voice stress analysis to catch liars. They analyzed the President's press conference live on television and again on videotape.

Their conclusion: The President lied more often than he told the truth. Even when he told the nation that he felt a "scorecard" would show he had been a good President who had told the truth more often than he had lied, he was, in fact, lying.

"The President exhibited all the classic symptoms of pathological prevarication," said Dr. Stephanie Crossfield, a psychologist who treats people who have trouble telling the truth. "His eye movements, gestures, and changes in voice tone all point to a consistent evasion of the truth."

Jonathan Rensley, a private investigator who used a voice stress analyzer to monitor the President's performance during the press conference, agrees.

"In spite of his demeanor, the President's voice patterns showed unusually high levels of stress, consistent with someone who is not telling the truth," Rensley said.

At Capitol Hill Blue's insistence, Dr. Crossfield and Rensley did not make their judgement based on one viewing of the President's performance or by consulting with each other. Both watched the press conference live, then rechecked their findings by viewing a full videotape of the press conference on both Saturday and Sunday to confirm their findings.

Without consulting with each other, they concluded the President was lying at several points in his press conference, including:

"Eye movement is difficult to control," she said. "The eyes dart away in specific patterns when a person is not telling the truth. The President's eyes dart a lot."

"We love each other very much and we're working at it," Clinton said of his wife and their problems. Dr. Crossfield said Clinton's eye movement indicated lying when he said he loved his wife. Rensley's voice stress analyzer said the same thing.

And even though the President refused to answer ABC newsman Sam Donaldson's question of his guilt of the charges of rape by Arkansas businesswoman Juanita Broaddrick, both said Clinton's demeanor suggested he was hiding something.

"His eyes looked away in a pattern that is consistent with evasion and concealment," said Dr. Crossfield. "His body language was not that of a man who was being truthful."

Likewise, Rensley's voice stress analyzer said the President was lying when he said: "There's been a statement made by my attorney. He speaks for me, and I think he spoke quite clearly."

"He's hiding something serious. If I were conducting this test on a potential employee for a client, I would advise against hiring the person because he can't be trusted."

Ellis Jr., commander in chief of allied forces in Southern Europe, at an �admiral�s mast,� a nonjudicial proceeding, at Ellis� headquarters in Naples, according to U.S. Naval Forces Europe spokesman Capt. Stephen Honda.

Semko was relieved of his command but kept on Ellis� staff pending reassignment by the Navy Personnel Command.

A Navy officer familiar with the case said the punishment is virtually certain to end Semko�s career.

Honda said Ellis found that Semko had violated Article 133 of the Uniform Code of Military Justice by committing �conduct unbecoming an officer.� Honda said Semko had an extramarital affair with a civilian not in his command and had made a false official statement during the Navy�s investigation. He declined to provide other details. Semko is married and has two children.

The matter was investigated by the Navy Inspector General�s office in Washington after it received an anonymous letter in January alleging misconduct by Semko. A Navy official in Washington familiar with the investigation said the letter was submitted by the woman Semko was involved with. The official, speaking on condition he not be identified, said the affair ended early in 1998.

Ellis conducted his own investigation and concluded that �the allegation was substantiated,� Honda said.

Semko�s is the latest in a string of cases of senior military officers receiving punishment for sexual misconduct.

Last December, Rear Adm. John T. Scudi was found guilty of adultery, obstructing justice and improperly steering defense contracts to a woman with whom he was having an affair. Scudi was found to have committed seven violations of three different articles of the Uniform Code of Military Justice. He was punished with a 30-day arrest in his quarters and ordered to forfeit one half of his pay for the next two months, plus he received a punitive letter of reprimand for his actions.

Last week, retired Army Maj. Gen. David Hale was ordered to pay a $10,000 fine and forfeit $12,000 of his pension after he admitted on the opening day of his court martial to adulterous affairs with the wives of four subordinates. He had the affairs while serving in Turkey from 1996 to 1998.

Semko, the Navy admiral, began his career in 1970 and had been commander of Fleet Air Mediterranean, based at Naples, since May 1998. In that post he was commander of all U.S. land-based naval air forces; six Navy shore bases reported to him. He also was commander of the U.S. Sixth Fleet�s maritime surveillance and reconnaissance forces and commander of NATO�s maritime air forces in the Mediterranean.

Our Leaders must be held to the highest standards because they have that power, power we gave them at the ballot box. Message: Bill Clinton resorts to lawyer-speak when quizzed about his personal affairs, but he is crystal clear about his agenda for American primary and secondary education. Consider his remarks in the State of the Union Address. The President proposed hiring 100,000 new teachers, building 5,000 new schools and implementing "the first-ever national effort" to reduce class size to 18 students in the first three primary grades.

Despite the applause his remarks drew, Mr. Clinton deserves a grade of "F" for wanting both to increase federal powers in affairs best left to the discretion of individual states and to pour more funds into the black hole of public education.

American companies are currently spending billions of dollars a year on remedial education for their employees, thanks to public school teachers who promote students who can barely speak or read English. Public schools have also become crime scenes where drugs are peddled, teachers are robbed, students are assaulted in restrooms and homemade bombs are found in lockers. A Metropolitan Life study released in 1993 reported that over 10 percent of teachers and 25 percent of students had been victims of violence at or near their public schools.

This educational quagmire is driving parents to choose the educational alternative known as homeschooling. In 1996, the Florida Department of Education surveyed 2,245 homeschoolers. Thirty-one percent returned the survey. Of that group, 42 percent said that dissatisfaction with the public school environment (safety, drugs, adverse peer pressure) was their main reason for establishing a home education program.

Homeschooling was the way the Founding Fathers received their education. Today�s homeschooling movement continues to excel by producing literate students with minimal government interference at a fraction of the cost of any government program.

McDougal answers questions about Clinton for the first time

She says president was truthful in his testimony

LITTLE ROCK, Arkansas (AllPolitics, March 23) -- Finally answering the questions that cost her 18 months in jail and has her on trial for criminal contempt and obstruction of justice, Whitewater figure Susan McDougal testified Tuesday that President Bill Clinton, as far as she knows, testified truthfully in 1996 about the controversial land deal.

"Nothing that he said was untrue to me. As I sat there that day, I did not hear anything untruthful," she said when asked by her attorney Mark Geragos if Clinton told the truth in his videotaped deposition in her 1996 Whitewater trial.

Independent Counsel Ken Starr's office pursued the current charges against McDougal after she refused to answer the same questions about Clinton and first lady Hillary Rodham Clinton in September 1996 and again last April.

McDougal spent most of Tuesday on the stand and was expected to resume her testimony Wednesday.

During the afternoon session McDougal told jurors that she believes her late ex-husband, James, had been paid off by political opponents of then-candidate Clinton to make the original Whitewater disclosures in 1992.

But Tuesday morning McDougal's legal team took the opportunity to respond directly to Starr's charges, by publicly asking their client the questions she refused to speak to in the closed-door grand jury.

McDougal began by testifying that she never spoke with Clinton about a fraudulent $300,000 loan in her name.

David Hale, another Whitewater witness, has testified that Clinton had pressured him to make that loan.

Earlier in the trial FBI agent Mike Patkus testified that a $27,600 check made out to then-Arkansas Governor and Whitewater partner Bill Clinton was paid in a complicated series of financial transactions that led to the illegal loan that sent McDougal to prison in a previous trial.

The cashier's check to Clinton in 1982 was used to retire existing debt on the original loan to buy Whitewater land, but did not bear Clinton's endorsement nor any identifiable fingerprints, the agent testified.

The president testified at McDougal's 1996 Whitewater trial that he knew nothing about the SBA loan and never had any financial transactions or loans from Madison Savings & Loan, a failed savings and loan owned by the McDougals.

In the past the president's lawyers have indicated that if there was a loan, Clinton was unaware of it.

What did Clinton know?

McDougal was also asked if Clinton knew about another of her real estate developments south of Little Rock called Lorance Heights.

"I might have in a social sense told him I was working out there. But certainly I never discussed any substantial thing about Lorance Heights with Bill Clinton," McDougal said.

Lorance Heights is also under investigation by prosecutors following the Whitewater paper trail.

McDougal has called the trial a "personal vendetta" by Starr. She has already served 18 months for civil contempt for refusing to answer grand jury questions about the Clintons.

She has said she refused to answer questions because she believes Starr would twist her words to suit his purposes and may charge her with perjury if he doesn't get the testimony he wants.

Testimony delayed over jury question

McDougal's testimony was delayed a day as Geragos argued unsuccessfully Monday to have a juror removed for possible bias against his client.

According to Geragos, juror Charles Adams expressed disdain for President Clinton and for Mrs. McDougal, a partner of Clinton in the Whitewater land development.

"I will not dismiss this juror," Judge George Howard Jr. concluded following arguments from both sides in his chambers, away from the jury.

In court, Geragos won a separate skirmish over whether the judge would allow defense witness Steve Smith to say whether he believed Starr's prosecutors were seeking the truth in using him in their investigation.

Smith, who pleaded guilty in 1995 to a conspiracy charge in the Whitewater investigation in exchange for his testimony, was allowed to answer the question after the prosecution grilled him about his knowledge of the law.

Smith told the jurors, "I think they were seeking truthful information that would conform with their theory of the case. They sort of had a story line about what happened."

A communications professor at the University of Arkansas at Fayetteville, Smith said Starr's deputies would listen if he had some information that conformed with their thinking but they weren't interested if his information didn't fit their ideas.

Rick Holiman, a Little Rock attorney who had represented two other McDougal associates including one of Susan McDougal's brothers, also testified for the defense that the Independent Counsel's office had used inappropriate tactics to pressure his clients.

The McDougals were partners with the Clintons in the Whitewater real estate venture in northern Arkansas.

If convicted, McDougal could face as much as 10 years in prison and a $750,000 fine.

As Hillary Clinton toys with a run for Daniel Patrick Moynihan's Senate seat, the main charge leveled against her has nothing to do with her conventional liberal views, her status as a politician's wife, or her smarmy New Age morality. Rather, critics blast her status as a carpetbagger--an Illinoisan, by way of Arkansas and Washington, D.C., who would exploit New York's lax residency requirements for personal glory. So how come no one cares that Moynihan was born in Tulsa, Okla.?
Of course, Moynihan grew up in New York. Still, the point is that in our highly mobile society, carpetbagging is as common a political sin as taking soft money or committing adultery. According to a 1993 tally by Roll Call, 36 senators and 145 House members--about a third of Congress--were born outside the states they represented. Sen. Robert Byrd, known for bringing federal pork to his West Virginia constituents, hails from North Carolina. And his junior colleague, Jay Rockefeller, isn't a native either. Presidential candidate Bob Smith, hoping to capture New Hampshire's critical primary as a native son, was born in Trenton, N.J. Yet the charge of carpetbagging remains a favorite campaign-season accusation. MORE. . . .

I don't want to live tax free, just free. I assume you have not seen the posts I have been making here for months. I have always despised all Government. I despise any waste (yes, even if the Republicans did it). By the way, the Iran-Contra investigation cost more, lasted longer, yielded nothing and was instigated by Democrats who were out to get a Republican president. This is the first time he's ever disagreed with Clinton's decision to use military force.)

I said I have little new information to add to the Whitewater investigation, I testified Wednesday that I believe my dear late ex-husband told Independent Counsel Ken Starr "stories" implicating President Bill Clinton in order win a lighter prison sentence for his 1996 Whitewater conviction.

Jim told me this is something he had to do because he did not want to die in jail. Jim did in fact die in prison in March 1998, while serving a three year sentence for business fraud. Before he began cooperating with the special prosecutor, Jim faced a possible sentence of 84 years in prison.

I recalled one conversation I had with Jim in which he was rehearsing his new Whitewater story. He said I have got a whole new twist, what do you think about the way I say this, does this sound believable ?

Before his death Jim agreed to cooperate with the Office of the Independent Counsel, confirming former municipal judge David Hale's allegation that Clinton knew about a fraudulent Small Business Administration (SBA) loan taken out in Jim name.

Hale, a prosecution witness in the McDougals' 1996 trial, has claimed that Clinton pressured him to make the fraudulent loan, defrauding the SBA through his Capital Management company.

Starr's evil office pursued the current charges against me after I refused to answer questions about the Clintons in September 1996 and again last April.

I refuse to respond because I believe Starr would twist my words to suit his purposes and may charge me with perjury if he doesn't get the testimony he wants.

I suspected you and I would be in agreement on this. That said, where the heck is Clinton getting support for this action (other than the boobs in the Senate who are too afraid to stand up for what's right for fear of making Clinton and the US look weak)? I am very saddened that my Republican representatives didn't have the intestinal fortitude to stand up for what's right and cut off the funds for this insane military action. I testified Wednesday that I believe my dear late ex-husband told Independent Counsel Ken Starr "stories" implicating President Bill Clinton in order win a lighter prison sentence for his 1996 Whitewater conviction.

They ask me questions, I give them answers. I think Ken Starr had a plan and it was to convict me so that he could then get testimony against the president.

Then that idiot Barrett had the nerve to say that Ken Starr didn't pick the 12 jurors.

Then I said that it was Starr's office that put on perjured testimony by prosecution witnesses.

But then I had to let them know that after my first trial, in which Jim , my late ex-husband, God rest his soul, and I were convicted of multiple felonies, Jim tried to persuade me to say that I had an affair with Clinton so Starr's office could get the president.

Jim told me that I didn't have to say that Clinton pressured a Little Rock judge to make the $300,000 loan that benefited Whitewater because I could just say that I had a sexual affair with Clinton. All eyes of the jurors were fixed on me. It was great.

I told them that Jim told me there is a man in Starr's office named Hickman Ewing who believes he can get Clinton on a sex charge before the election. Bombshell. You could have heard a pin drop.

Then that coward Ewing, outside the federal courthouse, said that my statement was outrageous. Then he says he never said anything like that, that he is positive nobody else said anything like that. What a load of bull.

Then the judge jumps all over me. He tells me that he wants me to understand that I am expected to respond to these questions. He was really frustrated. I am scouring points. Then he tells me that he is not about to let anybody manipulate this system. What a joke !

They were all so upset because I delivered expansive broadsides against Starr and the judicial system from the witness stand, despite their efforts to get me to stop talking. I will never stop telling the truth.

I told them that that prosecutors made clear in one conversation before my 1996 Whitewater sentencing that they were looking for damaging information on the Clintons. At that time, they said to me that I know who the investigation is about. I know who they want. We all know who they want.

But I don't have any damaging information on the Clintons and I am not willing to lie--even if it meant giving up the chance to have my life back.

After I was sentenced to prison for my Whitewater conviction, I said I was content knowing that I had not lied about anyone and had not let my words be twisted to harm the Clintons.

Even though I was going to jail, I felt I had a clearer perspective of what my life was supposed to be. . . . I felt I could live with myself.

The judge yelled at me not to give us a speech. Is that clear? But I had to say these things, because I've waited a long time for this day. To let the world know just how evil Ken Starr really is !

People now know that the Office of Independent Counsel is not fair. We didn't know that then, during my 1996 trial. I could not have gotten a fair trial because there's no way to guard against a ruthless prosecutor. I think Kenneth Starr had a plan and it was to convict me so that he could get testimony to use against the president. I think there's a bigger story here and that's why I'm sitting here.

Susan McDougal continues her life of lies, deceit, and criminal perjury. Those that were involved have quickly stepped forward to point out Susan's testimony on Tuesday was both perjury and absurd. Once a liar and a felon - always a liar and a felon:

Little Rock attorney Sheffield Nelson denied Wednesday arranging for James McDougal to receive money to speak with a New York Times reporter about Whitewater in 1992, as Susan McDougal, in testimony Tuesday, recalled her late ex-husband telling her.

A statement Nelson released Wednesday reads: "The statements made in court yesterday by Susan McDougal and by her attorney afterwards are absurd and untrue. Jeff Gerth, of The New York Times, contacted me to see if I knew Jim McDougal and could get him an interview with him. Jim McDougal contacted me to steer him to a writer to tell his story. The calls occurred within two weeks of each other, and I referred McDougal to Gerth.

"The statements made by Susan McDougal and her attorney were not true, and you can be sure that the issue would have been raised during the criminal trial of the McDougals or in the tell-all book Jim McDougal wrote about his life, had they been.

"Nobody should miss the important point that Jim McDougal died while in prison and is not available to refute the false statements now."

Susan McDougal testified Tuesday that James McDougal told her there was money involved in his agreement, at Nelson's behest, to talk to Gerth about Whitewater, the failed Marion County land deal in which the McDougals were partners with the Clintons. Asked to clarify Susan McDougal's testimony, her attorney, Mark Geragos, said Nelson arranged to have James McDougal paid: "The stories revolve around five-figure amounts."

James McDougal's interview with Gerth took place during Bill Clinton's first run for president.

The "tell-all book," Arkansas Mischief, doesn't mention any payoffs. Its version of how McDougal first spoke with Gerth differs from Nelson's statement and Susan McDougal's testimony Tuesday.

James McDougal wrote that in 1992, as Clinton's presidential bid gained strength and then-Lt. Gov. Jim Guy Tucker seemed likely to become governor, James McDougal became bitter at his two old friends and business partners.

Clinton and his wife, Hillary Rodham Clinton, had left him to take care of mounting debts in the Whitewater land deal, though they were equal partners, and Tucker conned him out of $59,000, James McDougal wrote.

Hoping to sue Tucker to regain the money that James McDougal claimed was owed him, McDougal contacted Nelson, whom he thought shared his dislike for Clinton and Tucker. In his first discussion with Nelson, he told of the Clintons' role in Whitewater and Tucker's involvement in other projects, James McDougal wrote.

"Nelson was gleeful," James McDougal wrote. "He wanted me to talk with Gerth, the New York Times reporter who had written a long, investigative article about the [Stephens'] extensive connections in Arkansas a few years earlier. Gerth had been sent back to Arkansas to snoop around on the Clintons' finances, and Nelson's office had been one of the first stops on the reporter's schedule." McDougal said he and Nelson had a subsequent meeting in which he gave Nelson more information on Tucker's activities.

"Nelson was delighted to have this information," McDougal wrote. "He could pass it to Gerth and hobble the 1992 Democratic presidential campaign. And he could deliver it to the Republican U.S. attorney's office and set in motion the events that could bring down Jim Guy Tucker." In her testimony, Susan McDougal told basically the same story that her former husband did, but she said James McDougal initially contacted Nelson in hopes that Nelson would represent him in a medical malpractice suit. The idea to sue Tucker came later, she said. Susan McDougal testified that Nelson was going to get James McDougal to meet Gerth and that there was money in the interview. She also testified that James McDougal was excited about the interview.

"He told me he was going to go down in history," Susan McDougal testified. "Jim McDougal was going to go down in history. And he was going to pay back the Clintons."

New York Times spokesman Lisa Carparelli said the newspaper stands by its 1992 story [Which means they are calling Susan a liar!]

"We don't know what the situation was between Mr. Nelson and Mr. McDougal. That remains between them," she said. "The Times' story has withstood the test of time since it was published in 1992."
